This document may refer to Telstar Events, Inc. as the “Company”, “we”, “us”, or “our”. This policy applies to your use of all websites, apps, or other online services provided by the Company, including saratogaocean.com, telstarevents.com, aguideforlightworkers.com, all subdomains of these sites, and any other site, webpage, or service we own or operate, which collectively will be referred to in this document as the “Service”. Where this document uses “you” or “your”, it refers to you as a natural person and individual user of the Service, and not to any company or organization with which you may be associated.

Through the use of the Service, you accept and agree to the data collection and usage procedures set forth within this policy. If you do not agree with any element of this policy, you should refrain from further use of the Service and from making any purchases from us.

How we collect information

Through your use of the Service, we collect different types of data from you and your device, such as personal data and usage data.

Personal Data

“Personal data” refers to any data or information relating to an identified or identifiable natural person. We collect different types of personal data through your use of the Service, for purposes described below. The personal data we collect from you may include things such as

  • Your history of interactions with different portions of the Service
  • Your interests or preferences related to our services, products, content, or potential future offerings

A subset of personal data is personally identifiable information (“PII”), which is data that can uniquely identify you as an individual, like your full name, email address, or social media handle. Please rest assured that we only collect PII that you knowingly and voluntarily provide, including when you make a purchase, sign up through a form, submit a review or comment, contact us, or follow our accounts on social media. If you have made other information publicly available online via an identity service like Gravatar, the Service may use your email address to retrieve that information.

Usage Data

As you access the Service, we automatically receive anonymous data about your activity, including your IP address, the browser and operating system in use, date and time of your visit, pages you visit, duration of your visit, referring websites, and browser or device settings such as language or time zone.

This information may be saved in cookies or server logs, or transmitted to our analytics systems via beacons, tags, pixels, or similar tracking technologies.

In some instances, the same pieces of data (such as an IP address, cookies, device language, or referrer) may separately be collected for different purposes as both personal data and anonymous usage data.

About Cookies

Cookies are small pieces of text that a website saves to a computer or mobile device for identification or record keeping purposes. We use cookies, as well as similar standard web technologies including Local Storage, Session Storage, and Indexed Database (together referred to as “Cookies”), to operate and improve our Service.

We use different kinds of Cookies in various ways that make it easier and more enjoyable to use our sites, as well as to better understand how users interact with the Service. For example, some Cookies are used to remember when you are logged in and give you access to a product or membership you have purchased, while other Cookies keep track of your preferences as you browse, and others let us learn how well our marketing and advertising is working. Please note that Cookies stored on your device are only as secure as your device itself. If someone gains access to your device (with or without your permission), or installs malware on your systems, they may be able to see cookies set by any site you visit, including our Service. We have no control over this. For this reason, we strongly encourage everyone using the Internet to use strong passwords, keep all software up-to-date, and follow other security best practices.

Third party cookies

We use a variety of 3rd party technologies to improve the Service, including social media buttons, comment boxes, secure payment systems, analytics tools, sign up tools, audio and video players, chat and support widgets, personalization tools, and remarketing pixels, among others. Many of these technologies communicate directly with your device and use their own Cookies to operate. Please read the section of this policy on how we work with 3rd parties to process your data.

Do Not Track requests

The Service does not respond to a web browser’s Do Not Track requests, and these signals do not currently alter our processing in any way.

How we use your data

The Company makes use of personal data and other usage information for a variety of purposes as necessary for our operations, interests, contracts, and legal compliance, as explained below.

When we collect your data for one purpose, we may additionally process it for other purposes listed in this document, as long as the additional purposes are compatible with the original purpose for which the data was collected. A compatible purpose must be lawful, fair, and reasonable in relation to the data itself and our business relationship with you. If the purposes are incompatible with the original purpose, we will not process the data unless we first ask for and receive your explicit consent to do so.

To fulfill contracts with you

We use your personal data to deliver goods, products, and services you have purchased, as required by contract. This may include processing payments; shipping physical products to you; maintaining a user account for you on the Service; contacting you via email, phone, SMS, or other appropriate means to deliver invoices, receipts, announcements, updates or other information directly related to your purchase; providing customer service; and maintaining an accurate customer database.

We process your personal data as necessary to negotiate, perform, enforce, or update agreements and contracts we have with you, and to notify you of such actions, as well as to enjoy our rights under such agreements.

To market our products and services

We process your personal data to market our products, services, events, and content to you if you have consented to receive such marketing or if we have a legitimate interest in doing so that we deem is fair and in balance with your interests.

Marketing messages we send to you

We will send you marketing messages via emails, text messages, phone, direct messages, direct mail, push notifications, or other communication channels only if you have implicitly or explicitly given us your permission to do so through that channel.

You grant us permission to send you marketing messages when you provide your contact information to us in the course of activities that include subscribing to a newsletter; signing up to access a free guide, video, or other content; opting in for updates about new offers, products, or content; or similar acts.

If you make a purchase from us or contact us to receive a quote or otherwise negotiate a sale, we regard this as implicit permission to send you marketing messages about that or similar products or services we offer, unless you indicate otherwise. We base such processing on our legitimate commercial interest as a business, and only conduct it where we believe the offers and content we send you are helpful and relevant. Unless you subsequently give us express consent for marketing or make another purchase, we will stop sending you marketing messages no later than two (2) years after the original purchase or negotiation.

You may withdraw your consent to receive marketing messages at any time. We will inform you of how to withdraw consent on a channel at the time you give us permission to contact you via that channel. For our email newsletter and promotional emails, you can unsubscribe at any time by clicking the unsubscribe link at the bottom of any email.

You can also contact us at support@saratogaocean.com if you wish to be removed from any marketing or mailing list. Please provide us with your full name, email address, mailing address, and phone number so we may ensure that all your information is removed according to your wishes.

Please be aware that if you withdraw your consent to receive marketing communications and later re-consent by subscribing, making a purchase, or signing up again, we will resume relevant processing of your data and may send you marketing information through the channel for which you have newly given consent.

Personalization and advertising

We process personal data to tailor our marketing and content based on your purchases, interests, and recent interactions with the Service. We base this processing on our legitimate interest in providing you with the best possible experience as a user or customer.

We accomplish this through means including the use of cookies, tracking pixels, JavaScript, and selective use of third-party remarketing services. Some of the specific intents for which we process your data this way are:

  • To personalize the Service by recommending content or products based on your interests or activity
  • To identify users across different devices and make for a consistent experience
  • To relevantly advertise our products and services on third-party sites or apps
  • To avoid showing you irrelevant or annoying ads or banners (for example, ads for a product you already bought)

To provide and improve our services

Information we collect or that you submit to us will be used by the Company only as necessary for our legitimate business interests, including to provide and maintain the Service, to optimize our marketing, and in the course of general business operations.

We keep records of activity on the Service for analysis in order to uncover trends, assist in the operation of our websites, and ensure delivery of the Service. This includes recording heatmap, clickstream, and browser session data in order to understand our users’ needs and experiences.

We also use personal data to enable functions on the Service, such as recent activity feeds, suggested content, aggregate ratings, social media features, comments, and delivering messages on behalf of other users.

We may use data we collect from you to survey you about your experience with the Service, or to ask for a review or testimonial after a purchase. This and other data allows us to improve our products, sites, and services, and to create new products and services to meet the needs of our market.

The company may deem it necessary to follow websites or social media pages that our users may frequent in an effort to assess what types of services or products may be the most popular to customers or the general public.

Finally, we process data in order to conduct standard business operations and keep accurate records for financial, legal, insurance, and operational purposes.

User-submitted content

Parts of the Service may give you the opportunity to submit comments, reviews, testimonials, ratings, user bios, photos, or other content for public display. These qualify as personal data insofar as they are connected to you as a user. In all such cases, by submitting this content to the Company you affirm that you a) are its author or have the right to share it, b) consent to its publication, and c) grant Telstar Events, Inc. a full license to use it at our discretion throughout the Service. We will only publish user-submitted content fairly in relation to the context for which it was created.

We are not responsible or liable for the accuracy of user-submitted content, or for any personal data that may be shared therein without the subject’s permission.

We may process your personal data or disclose it, without prior notice to you, where we have an obligation to do so under applicable law in order to

  • Comply with subpoenas, court orders, warrants, and other law enforcement requests. This may involve disclosing your personal information without prior notice to you if required by law.
  • Comply with opt-out requests, objections to processing, and other exercise of your privacy rights
  • Maintain accurate records if explicitly required by law or statute to do so, or in a good faith belief that such action is necessary to remain in conformance with any law or statute

The Company may also process or disclose personal information in special cases when we have reason to believe that it is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference (either intentionally or unintentionally) with the Company’s rights or property (including Intellectual Property), other users of the Service, or anyone else that could be harmed by such activities.

Data processing by third parties

Like most technology-centric and e-commerce businesses, the Company uses third-party services (“data processors”) to process certain data on our behalf, including personal data. These services generally fall into four categories:

  • Third parties we contract with to support our internal operations
  • Third parties we contract with to provide parts of the Service or help us fulfill customer needs (such as payment processing, shipping and delivery, or email systems)
  • Third parties we contract with to help us analyze activity on the Service
  • Advertising platforms

These data processors process data on our behalf for the purposes described in this policy. If these processors have access to your personal data, they use it only to act on our behalf and are prohibited from making use of your information for any unrelated purpose. We strive to work only with third parties who have high standards for data protection and technical security.

As you use the Service, in some cases, your browser or device may communicate directly with a data processor via a technical interface the Service provides. We wish to provide you with additional information about three particular instances where this occurs:

Analytics tools

We use industry standard analytics tools like Google Analytics and Hotjar to monitor and analyze the use of the Service for the purposes described. These tools use first-party and third-party Cookies and other technologies to collect data on our users’ behavior, demographics, and devices. This information is stored in a pseudonymized user profile.

Google Analytics data may be shared with other Google services as described in their partner policy where we have explicitly linked such services for purposes described in this Policy. We do not permit Google to use person-level data for other purposes. Google Analytics does not process Personally Identifiable Information (PII) and does not permit PII to be shared with their service. We may use Google Analytics Advertising Features including demographics and interests reporting and Google Display Network impression reporting. To opt out of data collection by Google Analytics on the Service and third-party sites, install the Google Analytics Opt-Out Browser Add-On.

Remarketing advertising services

We use third party remarketing services to show our advertisements to you after you visit the Service. These services may use Cookies, pixels, data hashing, or other technology to understand how you engage with the Service so we can show you ads relevant to your experience.

We use Facebook’s custom audience remarketing service (“custom audiences”) to show more relevant ads to users who have shared their contact information with us. Custom audiences use a secure cryptographic process called data hashing to match our data with information Facebook holds about its users, without actually sharing any PII with Facebook. Data hashing is an irreversible mathematical procedure that translates data (like an email address) into an inscrutable string of numbers and letters. If you have not shared your contact information directly with Facebook, there will be no way to match the information.

In the future we may use services similar to custom audiences provided by other advertising companies, as long as they guarantee at least an equivalent level of privacy and security for our user’s personal data. These shall also be covered under this policy.

If you are in Canada, you can control your settings through the Digital Advertising Alliance of Canada at youradchoices.ca/. If you are in Europe, you can control your settings via the Your Online Choices site at www.youronlinechoices.eu/.

Payment processing

For your security, the Company only processes online payments through third party payment processors. We work with best-in-class payment processors who adhere to strict PCI-DSS standards set by the PCI Security Standards Council, a joint project of payment brands like Visa, MasterCard, Discover, and American Express. The payment processors we use are Stripe (Stripe privacy policy) and PayPal (PayPal privacy policy). All order forms and checkout pages are loaded over a TLS encrypted connection and process transactions directly with the payment processor. We do not store any sensitive credit card information on our own systems.

Limitations on third party data sharing

Telstar Events, Inc. does not now, nor will it in the future, sell, rent or lease any of our customer lists, databases, or other records of personal data to any third parties.

Telstar Events, Inc. may feel it necessary, from time to time, to make contact with you on behalf of other external business partners with regards to a potential new offer which may be of interest to you. If you consent or show interest in presented offers, then, at that time, specific identifiable information, such as name, email address, or telephone number, may be shared with the third party.

If you are referred to the Service by one of our affiliates or business partners, we may share limited personally identifying information or usage data with them to aid in their marketing or the delivery of any service they separately provide to you. In such cases their processing of this data will fall under their privacy policies and terms.

Notice for users of ad-blockers

The Service uses third-party tools including Google Tag Manager and Drip to manage and control different ways the Service processes personal data and usage data during your visit. This may include verifying your agreement with or choices pertaining to this Privacy Policy. If you use functions in your browser or ad-blocking software to restrict, modify, or disable these tools’ intended operation, this may result in unintentional automated processing of your data. We do not authorize or condone such modifications, and are not responsible or liable for any consequences thereof. If you wish to adjust the ways we process data from you and your device, please use the various solutions we provide or recommend in this document.

The Company is not responsible for the content or practices of third party websites that may be linked to the Service. The Company is also not responsible for any information that you might share with such linked websites. This Privacy Policy applies only and solely to the information collected by our Service. It is highly recommended and suggested that you review the privacy policies and statements of any website you choose to use or frequent as a means to better understand the ways in which other websites garner, make use of and share information they collect.

We are a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for us to earn fees by linking to Amazon.com and affiliated sites.

International data transfers

Privacy laws differ greatly by jurisdiction, and rights or protections afforded in one region do not always apply in another.

Telstar Events, Inc. is based in the United States. Other third-party services we use may operate infrastructure in the United States or other countries. At a minimum, you should expect that any data we collect will be transferred, processed, and stored in the United States.

Your data and privacy rights

Rights of European residents

Residents in the European Economic Area (EEA) hold certain rights under the General Data Protection Regulation (GDPR) related to how we process their personal data. These rights are as follow:

  • The right to be informed of how your personal data is processed. This Privacy Policy together with privacy notices on the Service are used to inform you when, how, and why we process your data.
  • The right of access to the data we hold on you.
  • The right to rectification: you have the right to challenge the accuracy of your data and ask us to correct it, or where possible to correct it yourself through an interface we provide on the Service.
  • The right to erasure (“right to be forgotten”): you have the right to have your personal data deleted, unless there are specific legal reasons why we need to continue processing it.
  • The right to restrict processing under circumstances given in Article 18 of the GDPR.
  • The right to data portability: if we are processing your data for a purpose based on a contract or your consent, you can request a copy of your data in a commonly-used, machine-readable format.
  • The right to object to processing of your data. Where we are processing your data for direct marketing, you can object regardless of reason and we will stop such processing.   • The right to withdraw your consent for processing.

If you believe we hold inaccurate personally identifiable information about you and wish to correct it, or if you wish to opt out of a particular type of data processing described in this policy, or if you have further questions about how we use your data, follow the process below. We will respond to a request to exercise privacy rights within 30 days after receiving the request. It may take longer to make a decision about or comply with your request if it is unusually complex. To protect our users’ personal data, we may require you to verify your identity prior to us acting on a request. We will not charge you any fee for complying with your requests, unless your requests are manifestly unfounded or excessive, in which case we may charge a reasonable fee.

If you are a European resident and feel our response is unsatisfactory or believe we are processing your data in violation of GDPR, you have the right to lodge a complaint with the supervisory authority in your country.

Security

Security for all personal data and other information is extremely important to us. We take reasonable precautions to maintain adequate physical, procedural, and technical security as appropriate with respect to the data we store. These precautions are intended to minimize the risk of any loss, misuse, unauthorized access, disclosure, or modification of personal or other data under our control. Precautions include educating employees about security best practices, encrypting sensitive information, using two-factor authentication where possible and necessary, and employing TLS encryption for web traffic to provide all users with secure, private access to the Service.

(“SSL” refers to an earlier, outdated method of web traffic encryption, but the term is still used colloquially to refer to TLS. If you see a reference to SSL on the Service, it means TLS. We do not use the actual, insecure SSL protocol.)

Unfortunately, no data storage system or transmission over the internet can be guaranteed to be 100% secure at all points. As a result, while we strive to protect your personal information, the Company cannot ensure or warrant the absolute security of any information during transmission over the internet or while stored on our systems or our partners’ systems. By transmitting any information to the Company, you accept that you do so at your own risk.

Please note that email is not a secure method of communication, and we strongly advise you not to send us sensitive personal information (such as payment information) via email. If you do so, it is at your own risk and we disclaim all responsibility for any consequences.

Data retention period

We only retain your personal data for the length of time necessary to process it for the purposes stated in this document, or for as long as we are obligated by law. We may retain anonymous usage data or pseudonymized data that can no longer be linked to an identifiable person for different periods.

Children under age of 13

The Service is not intended for children under the age of 13. The Company does not knowingly collect personal identifiable information from children under the age of 13 without verifiable parental consent. If it is determined that such information has been inadvertently collected on anyone under the age of 13, we shall immediately take the necessary steps to ensure that such information is deleted from our system’s database. Anyone under the age of 13 must seek and obtain parent or guardian permission to use this website.

Changes to this agreement

The Company reserves the right to update or change the terms of our Privacy Policy at our discretion. We will post notice of substantive changes to this Policy to the Service homepage(s), so that our users or visitors are always aware of the type of information we collect, how it will be used, and under what circumstances, if any, we may disclose such information. If at any point in time the Company decides to make use of any personal data on file, for a purpose vastly different from those which were covered under this Policy when the data was initially collected, the affected user or users shall be promptly notified by email or other appropriate means. Users at that time shall have the option as to whether or not to permit the use of their information for this separate purpose.
